OF THE COMMON COUNCIL
VALPARAISO, INDIANA
October 11, 2021
The Common Council of the City of Valparaiso, Indiana, met on Monday October 11, 2021 at 6:00 p.m. in City Hall. Mayor Murphy called the meeting to order. The Pledge of Allegiance was said. Present were Councilmembers Cotton, Schmidt, Pupillo, Anderson, Costas and Douglas. Councilmember Reed was absent.
MINUTES
Councilmember Douglas moved to approve minutes of the September 27, 2021 meeting. Councilmember Schmidt seconded the motion. Upon voice vote the motion to approve passed with a 6-0 vote.
RESOLUTION NO. 14, 2021
A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF VALPARAISO, PORTER COUNTY, INDIANA, ADOPTING A FISCAL PLAN FOR THE ANNEXATION OF PROPERTY KNOWN AS THE “WESTWIIND ANNEXATION” AND THE VOIDING OF RESOLUTION 13-2021
Councilmember Douglas moved that Resolution No. 14, 2021 be read and considered for passage. Councilmember Costas seconded the motion. Clerk-Treasurer Taylor read Resolution No. 14, 2021.
Beth Shrader addressed the Board. The original Fiscal Plan was the annexation of the Westwind area. The Fiscal Plan has been amended to add two parcels that are further west than the original property. This Resolution voids Resolution No. 13, 2021 and reauthorizes the Fiscal Plan as amended. The land is proposed to be Rural Zoning. The developer has no immediate plan to develop the property.
Councilmember Cotton asked if it is the same owner. Beth Shrader replied there are two different owners that comprise three different parcels.
Councilmember Douglas moved to adopt Resolution No. 14, 2021. Councilmember Schmidt seconded the motion. Upon roll call vote the motion passed with a 6-0 vote.
ORDINANCE NO. 29, 2021
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF VALPARAISO, PORTER COUNTY, INDIANA, ANNEXING CERTAIN REAL ESTATE TO THE CITY OF VALPARAISO, INDIANA
Councilmember Douglas moved that Ordinance No. 29, 2021 be read a first time and considered on first reading. Councilmember Costas seconded the motion. Clerk-Treasurer Taylor read Ordinance No. 29, 2021.
Beth Shrader addressed the Board. This is the Annexation ordinance. It has been amended to add the extra parcels of land. She is still working with the parties on an Annexation Agreement. A copy has been distributed to the Councilmembers. They should contact her if they have any comments or questions.
Councilmember Cotton asked if contiguity requirements are met. Beth replied they are well over the contiguity requirements.
Councilmember Douglas asked about the walking paths. He would like assurance there will be a plan to put in a walkway to connect with the existing walkway. Beth replied the UDO requires there be sidewalks put in along all public rights of way when a property is developed. The Developer intends to put a walking trail on the north side of Pepper Creek.
Mayor Murphy stated Ordinance No. 29, 2021 requires a Public Hearing and presented Proof of Publication that at tonight’s meeting the Council will hear comments and questions regarding the “Westwind Annexation”. Attorney Patrick Lyp reported no requests or comments were received from the Public by email. Seeing no one wishing to address the Council, Mayor Murphy declared the Public Hearing closed.
Councilmember Douglas moved to carry Ordinance No. 29, 2021 to the October 25, 2021 meeting. Seconded by Councilmember Schmidt. Upon voice vote the motion passed with a 6-0 vote.
Reports
Councilmember Douglas reported the RDC meeting will be Wednesday at 4:00 pm in City Hall.
