MINUTES OF THE MEETING OF THE BOARD OF PUBLIC WORKS & SAFETY

VALPARAISO, INDIANA

December 22, 2021

The Board of Public Works & Safety of Valparaiso, Indiana met December 22, 2021 at 10:00 a.m. in City Hall. Present were Mayor Murphy, Steve Poulos, and Holly Howe. Mayor Murphy called the meeting to order and led the Pledge of Allegiance.

Motion: Holly Howe moved that the minutes of the December 10, 2021 meeting be approved, seconded by Steve Poulos and so approved.

Motion: Holly Howe moved that the claims be approved for payment and subject to appropriation balances, seconded by Steve Poulos and so approved.

MOU Between Valparaiso University and Valparaiso Fire Department

Mayor Murphy requested approval of a five-year MOU between Valparaiso University and the Valparaiso Fire Department. The Fire Department will provide education to VU and VU will pay the City $50,000 for these services. Attorney Patrick Lyp has reviewed and approved the MOU. Chief Dutz recommends the approval of this MOU.

Motion: oweHhhl;ll;H Steve Poulos moved to approve the MOU between Valparaiso University and Valparaiso Fire Department. Seconded by Holly Howe and so approved.

American Fidelity Agreement – Section 125

Attorney Patrick Lyp requested approval to American Fidelity to offer payroll deducted, supplemental benefits to City employees. In exchange, American Fidelity prepares the City’s Section 125 documents which allow employees benefits on a pre-tax basis. There is no cost to the City.

Motion: Steve Poulos moved to approve the Section 125 Flexible Plan Agreement with American Fidelity. Seconded by Holly Howe and so approved.

American StructurePoint SR 130/Froberg Road Traffic Signal

Mike Jabo requested approval of an Agreement with American Structure Point for Professional Engineering Services. On November 12, 2021 the BOW approved the recommendation of the Traffic & Safety Committee to install a traffic signal at the intersection of SR 130 at Froberg Road. The Engineering Department will assist in the design of this traffic signal. The work in this Agreement includes topographic survey, elevation survey of the SR 130 alignment for sight distance evaluation, establishment of apparent right-of-way, design of the traffic signal and utility coordination. Attorney Patrick Lyp has reviewed the Agreement. It is the recommendation that the Board of Works accept and sign the Professional Engineering Services Agreement with American StructurePoint as presented for a not to exceed fee of $36,050.00.

Motion: Holly Howe moved to approve the Agreement with American Structure Point for Professional Engineering Services for a not to exceed fee of $36,050.00 Seconded by Steve Poulos and so approved.

2021 Valparaiso Certified Street Mileage

Will Rose requested approval of streets to be added to the City inventory. Annually the City reports to INDOT the street mileage added to the City’s inventory over the previous year. There was no report submitted in 2020. This year the Engineering Department is recommending the inclusion of 4.55 miles in addition to the existing 165.122 miles for INDOT Certified Mileage. Included are new streets resulting from annexation, accepted streets from completed subdivisions, the SR 130 transfer to CR 250W, and roads that were not previously inventoried in past years. The Engineering Department recommends that the Board of Public Works and Safety accept the streets presented into the City inventory and allow the Mayor to sign the 2021 INDOT certification letter.

Motion: Steve Poulos moved to accept the streets as presented into the City inventory and allow the Mayor to sign the 2021 INDOT certification letter. Seconded by Holly Howe and so approved.

Elected Official and Personnel Bonds

Clerk-Treasurer Taylor presented bond renewals for employees that handle finances and assets including the elected official bonds for the Clerk-Treasurer and Mayor.

Motion: Steve Poulos moved to approve the Bonds as presented for elected officials and personnel. Seconded by Holly Howe and so approved.

301 Lincolnway

Attorney Patrick Lyp requested authorization to have Stu Summers continue acquisition discussions with the property owner of 301 Lincolnway. If necessary, Attorney Lyp requested he be given authority to move forward to seek the authorization.

Motion: Holly Howe moved to approve having Stu Summers continue acquisition talks with the property owner of 301 Lincolnway and to give the City Attorney authority to move forward if necessary. Seconded by Steve Poulos and so approved.

2022 Insurance Coverage

Clerk-Treasurer Taylor advised Anton has renewed the insurance for 2022.

Motion: Steve Poulos moved to approve the 2022 insurance coverage with Anton Insurance as presented. Seconded by Holly Howe and so approved.

There was no further business and the meeting was adjourned.
